TERMS AND CONDITIONS OF USE
1. PURPOSE AND SCOPE
These General Conditions govern access, browsing, and use of the website owned by Oscar Diaz Soler (hereinafter, the "Platform"), as well as contracting of advertising services offered through it.
The Platform aims to provide an online space for publishing classified ads intended exclusively for adults, where advertiser users may publish information on personal services and other users may access those ads and contact advertisers directly.
Access to and use of the Platform grants user status (hereinafter, the "User") and implies full and unreserved acceptance of these Conditions.
2. NATURE OF THE SERVICE AND ABSENCE OF INTERMEDIATION
TopPasion acts exclusively as an information society service provider, offering a technical service for hosting and disseminating ads.
TopPasion is not the provider of advertised services, does not act as an intermediary in their contracting, and does not participate in any way in relationships, negotiations, or transactions that may be established between Users.
In particular, TopPasion:
- Does not organize or manage meetings between Users
- Does not participate in setting terms or prices
- Does not receive commissions for services provided between Users
- Does not control or direct advertiser activity
Relationships established between Users are strictly private and external to the Platform, and are the sole responsibility of the involved parties.
3. ACCESS AND REGISTRATION CONDITIONS
Access to the Platform is free of charge, without prejudice to certain services requiring prior registration or contracting.
To publish ads, creating a user account is required, providing truthful, up-to-date, and complete information.
The User is responsible for safeguarding access credentials and for any activity carried out from their account.
TopPasion reserves the right to suspend or cancel accounts that breach these Conditions.
4. AGE REQUIREMENTS AND VERIFICATION
Use of the Platform is strictly limited to persons over 18 years old.
The User declares and guarantees compliance with this requirement.
TopPasion may require, at any time, verification of the User's identity and age by requesting valid official documentation (ID card, passport, or equivalent), as well as additional verification evidence.
Refusal to provide such documentation or submission of false information may result in suspension or deletion of the account without right to refund.
5. SERVICES OFFERED
The Platform offers ad publication and promotion services, including free and paid options that improve content visibility.
Contracting paid services is limited exclusively to acquiring advertising spaces or positioning improvements within the Platform.
Under no circumstances do such payments imply contracting personal services between Users.
6. ADVERTISER RESPONSIBILITY
The advertiser User is solely responsible for the content published, as well as for the truthfulness, legality, and accuracy of the information provided.
The advertiser expressly declares that:
- They are of legal age
- They act on their own behalf
- They hold all necessary rights over published content
- Their activity complies with applicable regulations
The advertiser assumes full responsibility for any claim, damage, or liability arising from their activity or published information.
7. ALLOWED AND PROHIBITED CONTENT
The User agrees not to publish content that:
- Involves minors or may induce their exploitation
- Promotes or is related to human trafficking
- Is illegal, fraudulent, or misleading
- Violates fundamental rights or third-party rights
- Includes third-party personal data without consent
- Contains violent, discriminatory, or degrading material
Likewise, use of the Platform for unlawful activities or activities contrary to public order is prohibited.
TopPasion may remove any content it considers contrary to these Conditions or applicable regulations.
8. MODERATION AND CONTROL SYSTEM
TopPasion may apply automated and manual content review systems.
However, the Platform does not perform exhaustive prior control of all published content.
In case illegal content is detected, or after receiving a valid notice, TopPasion will act diligently to remove or block such content.
9. DISCLAIMER OF LIABILITY
TopPasion does not guarantee:
- The truthfulness or accuracy of ads
- The quality or legality of advertised services
- Continuous availability of the Platform
TopPasion will not be responsible for:
- Relationships established between Users
- Damages arising from use of the Platform
- Unlawful actions of Users
TopPasion's liability will be limited under the terms permitted by applicable law.
10. PREVENTION OF HUMAN TRAFFICKING AND EXPLOITATION
TopPasion states its commitment to preventing human trafficking, exploitation, and any form of coercion or unlawful activity.
The publication of ads or content that:
- Are managed by third parties without the holder's consent
- Suggest control, coercion, or dependency
- May be linked to organized networks or illegal activities
- Generate reasonable indications of exploitation or lack of autonomy
is strictly prohibited.
Advertiser users declare that they act on their own behalf, freely and voluntarily, and are responsible for their activity.
TopPasion may adopt additional verification measures when risk indicators are detected, including requesting documentation or preventive suspension of content.
Likewise, the Platform reserves the right to remove content and cooperate with competent authorities when there are indications of activities related to human trafficking or any other unlawful conduct.
11. INTELLECTUAL PROPERTY
All elements of the Platform are owned by TopPasion or licensed for use.
Reproduction, distribution, or exploitation without express authorization is prohibited.
The User grants TopPasion a non-exclusive license to use published content for the purpose of providing the service.
12. SUSPENSION AND ACCOUNT CANCELLATION
TopPasion may suspend or cancel accounts in case of:
- Breach of these Conditions
- Publication of prohibited content
- Lack of identity verification
- Fraudulent or unlawful activities
Cancellation may occur without prior notice and without right to compensation.
13. DATA PROTECTION
Processing of personal data will be carried out in accordance with the GDPR and applicable regulations.

14. MODIFICATION OF CONDITIONS
TopPasion reserves the right to modify these Conditions at any time.
Modifications will be effective upon publication.
15. APPLICABLE LAW AND JURISDICTION
These Conditions are governed by Spanish law.
For resolution of any conflict, the parties submit to the Courts and Tribunals of the owner's domicile, unless legal provisions state otherwise.
